By accessing or using the Marq AI marketing platform ("Service"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access the Service.
2. Description of Service
Marq AI provides an AI-powered marketing content generation platform that enables users to create ad copy, social media posts, email sequences, and perform brand analysis. The Service utilizes third-party AI models (including OpenAI) to generate content based on user inputs and brand profiles.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.
4. Credits and Usage
Marq AI operates on a credit-based system. Each generation action consumes credits as specified in the platform. Free accounts receive 5 starter credits. Credits do not expire but are strictly non-refundable once consumed. Purchased credits are tied to your account and are non-transferable.
5. Intellectual Property
Content generated through Marq AI belongs to you, the user. However, you grant Marq AI a non-exclusive license to use anonymized, aggregated usage data to improve our AI models and service quality. Your Brand DNA profiles are never used for training purposes.
6. Limitation of Liability
Marq AI is an automated generative tool. We are not liable for the performance of your ad campaigns, email deliverability, or audience engagement resulting from the usage of generated copy. Users are responsible for reviewing all generated content before publication and ensuring compliance with platform-specific advertising policies.
7. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms, abusive usage patterns, or any activity that compromises the integrity of our platform. Upon termination, unused credits are forfeited.
8. Changes to Terms
We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will notify users of material changes via email or in-app notification.
9. Governing Law
These terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
